Probate is a Latin term meaning "to prove." We inherited the idea from the Romans and the British. In the last thirty years, the administration of estates has been greatly simplified. Kansas law provides several different methods of assuring that those entitled to the property of a decedent receive their
lawful share. Not all of these methods are called "probate." For example, there is a procedure called "informal administration" and one called "simplified administration" and there is also a process known as "determination of descent." With some of the methods, the probate court is not involved at all. Which method is best, the process and the procedure is determined by the value and type of property owned by the decedent at the time of death, as well as by the heirs and beneficiaries of the decedent and the creditors.
